Is Dutch web shagfest child porn?

Well, it is in the States apparently

If you're under 18 and fancy a webcam shagfest in the manner of the two Dutch teenagers seen going at it hammer and tongs earlier this week, better avoid posting it in the States. Phillip Jones explains:

Should be interesting to note that distributing nude images of minors (People under 18 years old) in sexual situations falls under child porn, at least in the 'states.

Reader Adrian goes further:

It is pretty funny, but what is happening to these kids is really unfortunate. If I were the father, I would very much take legal action against the retecool website, and since the pics have now reached the U.S., they may have a defamation of character lawsuit on their hands. If they won a settlement in the U.S. they would make it impossible for the owners of retecool to do any kind of e-commerce or enter the U.S. without being subject to the settlement and or jail time. Why jail time? They are illegally distributing child porn over the internet and drawing people to their site, and thus profiting off it too, which makes them also subject to international law.

Hold on a minute. This is a Dutch website. Whether or not the participants are underage is a matter for the Dutch. The father, too, would have to make his case in the Netherlands, surely. Since when is this matter subject to US law?

A while back we reported on French legal attempts to prevent Yahoo! from holding on-line auctions of Nazi memorabilia (the buying and selling of such material is illegal in France). The resulting, and as yet inconclusive, mess has still to be adequately resolved. Now, a US judge has agreed to consider whether law courts can determine what Web sites based in other countries can host (story here.

In conclusion we have Tom Macleod, who has another sorry tale to tell:

I go to North Carolina State University where a somewhat related incident happened about a year ago. Apparently this couple in my dorm decided to use their webcam to record their little "fling". Well his roommate hacked his password and put the file (70+ Megs!) on the network. Needless to say it spread to the entirety of NC in a matter of 3 days. I also heard stories of people in many other states getting the file. Anywayz, it was funny to eat in the cafeteria with them 'cause everyone pretty much laughed under their breath and pointed. Funny stuff

Hmmm, students, eh? Is there no end to their merry pranks?

Thanks to Joris Dirks for a bit of clarification regarding Dutch law:

According to article 240b of the dutch law it is illegal to publish/exhibit/create/import/export/store pictures of sexual acts appearing to involve someone that isn't yet *16*, not 18 or 21 or whatever. Punishment is 4 year max. Exceptions are made, like in other countries, for storing pictures for educational purpose, research or as therapy.

So, 16 it is.
