Judge sets the date for Patent Smackdown 2: The Damages

Apple and Samsung go toe-to-toe again in November

US Judge Lucy Koh has told Apple and Samsung they'll be back in court in November to try to decide whether the fruity firm deserves an extra $450m damages for alleged patent infringement.

The judge has set trial dates for the 12th, 13th, 14th, 15th and 18th of the month in front of eight new jurors, after a previous jury found in favour of Apple to the tune of an original $1bn.

Since then, Koh slashed damages to under $600m and ordered a new trial on the $450.5m that is still in dispute.

The pair of warring firms have filed various motions, all amounting to the argument from Sammy that the first jury was dead wrong and maybe even biased and the rebuttal from Apple that the jury was dead right and actually it should get even more money.

However, the new trial won't allow the pair of patent-battlers to bring in any new sales data, products or methodologies or theories, it's just to set the amount of damages after Koh ruled that the first jury incorrectly calculated the part of the award that led to the $450.5m slash.

Ultimately, the replacement award could be a lot more - or a lot less - than the $450.5m that was vacated. ®
