Rounded corners on Android phones cost Samsung $548m: It will pay up to Apple after all

But continues challenging validity of patents

Samsung says it will pay Apple the $548m it was told to cough up for infringing the iPhone's round corners among other patented designs.

The South Korean electronics giant said in a submission [PDF] to the US District Court in San Jose, California, that it has asked Apple to invoice it $548,176,477, which Sammy will pay within 10 days.

The sum was awarded to Apple by the court after a jury found that Samsung had ripped off Apple's iPhone and iOS user interface.

"Samsung has confirmed to Apple that it will pay Apple the $548 million partial judgment directly. Samsung indicates that payment should be complete within 10 days of delivery of Apple's invoice to Samsung, which will take place on December 4," Apple said in the filing.

"Once payment is received, Apple will withdraw the motion to enforce with respect to the partial judgment."

The multimillion-dollar payout could all but close the book on this chapter of the legal feud between Apple and Samsung, with one important caveat. Samsung continues to appeal the decision and challenge the validity of the patents Apple has asserted in its claim. Should Samsung prevail in either of those efforts, it will seek to get its money back from Cupertino.

"Samsung further reserves all rights to reclaim or obtain reimbursement of any judgment amounts paid by Samsung to any entity in the event the partial judgment is reversed, modified, vacated or set aside on appeal, or otherwise, including as a result of any proceedings before the USPTO addressing the patents at issue or as a result of any petition for writ of certiorari filed with the Supreme Court," Samsung noted.

Meanwhile, the two companies remain at odds in a number of other patent cases regarding the design and function of both the Samsung Android handsets and Apple's iPhone series. ®
